Terms of Service

These terms govern your use of Claimful. We've kept them in plain English — no tricks, no fine print traps. If anything is unclear, email legal@claimful.app.

1. Acceptance of terms

By creating an account or using Claimful, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the service.

2. Eligibility

To use Claimful, you must be:

  • At least 18 years old
  • A resident of the United States
  • Not a “prohibited person” — not on the OFAC SDN list or subject to US sanctions, and not located in a US-embargoed jurisdiction
  • Not barred from using financial services under applicable law

If you create an account on behalf of an organization, you represent that you have authority to bind it.

3. Your account

  • One account per person. No multi-accounting.
  • You're responsible for keeping your credentials secure. Use a unique password and enable any second-factor we offer.
  • Don't impersonate anyone else or create accounts with false information.
  • Notify us at security@claimful.app if you suspect unauthorized access.

4. Acceptable use

Claimful is for your personal, non-commercial use. You may not:

  • Scrape, crawl, or bulk-download content from the site without our written permission
  • Reverse-engineer the product or its matching algorithm
  • Use automated tools to access the service beyond published rate limits
  • Circumvent any access or rate controls
  • Use the service to build a competing product or dataset

Researchers, journalists, and the curious: email hello@claimful.app. We're usually happy to grant access with reasonable limits.

5. Intellectual property

We own the software, brand, matching logic, aggregated opportunity dataset, and content we write (landing pages, blog posts, category descriptions).

Underlying opportunity data (settlement notices, government benefit pages, bank offer terms) is sourced from public domain or publisher sources. We don't claim ownership of those upstream facts.

6. Opportunities disclaimer

Important: we surface information, we don't guarantee outcomes.

  • We do not guarantee you qualify for any specific claim, settlement, benefit, or bonus listed on the site.
  • Payout estimates are based on public information and may be wrong. Always verify directly with the official source (class-action administrator, bank, state treasury, etc.).
  • Deadlines, terms, and eligibility change. Confirm current details before submitting any claim.
  • Nothing on Claimful is legal, tax, or financial advice. Consult a qualified professional for your situation.

7. Affiliate relationships

Some “Apply Now” links — particularly for bank bonuses and credit-card offers — are affiliate links. If you open an account through one, we may earn a commission at no cost to you.

  • We disclose the affiliate relationship next to each affected opportunity.
  • Affiliate commissions never change your matching rank or eligibility filters. We show you offers because they fit your profile, not because they pay us more.
  • We do not earn commissions on class actions, settlements, unclaimed property, or government benefits.

8. User content

You retain ownership of everything you create on Claimful — notes, claim statuses, referrals, and any text you enter.

You grant us a worldwide, royalty-free, non-exclusive license to store, display, and process your content solely for the purpose of operating and improving the service. This license ends when you delete the content or your account.

9. Prohibited conduct

  • Submitting fraudulent claims (to class-action administrators, state treasuries, banks, or anyone else) based on information from Claimful
  • Creating fake referrals or multi-accounting to game referral rewards
  • Spam, phishing, or harassment of other users or our staff
  • Uploading malware, exploit payloads, or content that violates the law
  • Impersonating other people or organizations
  • Interfering with or degrading the service (DDoS, resource exhaustion)

10. Suspension & termination

We can suspend or terminate your account if you violate these Terms, engage in fraud, or if we're legally required to. Where feasible, we'll tell you why and give you a chance to respond.

You can close your account at any time from Settings → Danger zone.

11. Warranty disclaimer

The service is provided “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the service will be uninterrupted, timely, secure, or error-free.

12. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the service is limited to the greater of:

  • the amount you paid us in the 12 months before the claim, or
  • US$100.

We're not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, lost opportunities, or lost data), even if we've been advised of the possibility.

13. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your misuse of the service, your violation of these Terms, or your violation of any law or third-party right.

14. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. For any dispute not subject to arbitration (see next section), the state and federal courts located in Delaware will have exclusive jurisdiction.

15. Arbitration & class waiver

Please read this carefully. Any dispute arising out of or related to these Terms or the service will be resolved by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, administered in Delaware (or remotely, at your option).

Class-action waiver: you and we agree that disputes will be resolved only on an individual basis. You may not bring a claim as a plaintiff or class member in a class or representative action.

Exceptions: either party may bring a claim in small-claims court, and either party may seek injunctive relief in court for intellectual property infringement. You have the right to opt out of this arbitration agreement within 30 days of creating your account by emailing legal@claimful.app with “arbitration opt-out” in the subject line.

16. Changes to terms

We may update these Terms from time to time. For material changes, we'll email you and post a notice in-app at least 30 days before the changes take effect. Continued use after the effective date means you accept the new Terms. If you don't accept, close your account before the effective date.
